MotiFIT Fitness Inc. (“FITIV,” “we,” “us,” or “our”) respects your privacy and is committed to protecting your personal information.

This Privacy Policy explains how we collect, use, store, and share your information when you use our mobile applications, websites, and related services (collectively, the “Services”).

If you are a resident of the European Union (“EU”), MotiFIT Fitness Inc. is the controller of your personal data for purposes of EU data-protection law.

By using FITIV, you consent to this Privacy Policy. If you do not agree, you should discontinue using the Services immediately.

2. Information We Collect

FITIV collects only the information necessary to provide you with the best possible experience.

2.1 Information You Provide

• Account information: name, email address, and password
• Subscription and billing information: handled securely by the App Store; FITIV does not store or process payment details
• Profile information: gender, age, height, weight, fitness goals, or other data you choose to provide

2.2 Health and Fitness Data

FITIV collects and displays information from Apple Health and the HealthKit API to help users understand and improve their health and fitness. You will be asked for consent before FITIV accesses specific health metrics. Each health metric’s access can be granted or refused through the Apple Health app.

The health and fitness information gathered by FITIV from Apple’s HealthKit API is not shared or sold to any third parties for advertising or marketing purposes. FITIV uses this data solely for insights, analytics, and personalized experiences within the app.

2.3 Device, Location, and Usage Information

We collect limited technical and location data automatically to ensure accurate tracking and app functionality.

Location Information: We collect and process location data when you use location-dependent services. GPS-related workout information, including route mapping, speed, and direction, requires physical location collection. Location data may be collected while the app runs in the background for workout-tracking services.

Technical Information: We collect technical information about your device, including log files and analytics, device type, operating-system version, app version, diagnostic logs, and performance data to maintain reliability and improve user experience.

2.4 FITIV Community

FITIV collects data when you engage in the FITIV Community, including submitted content, usernames, interactions, profile photos, group content, and in-app friends.

By participating in the FITIV Community, you authorize FITIV’s collection of this data as well as public sharing of certain fitness metrics like calories burned, distance, FITIV Points earned, and workout time.

Because the FITIV Community is a public forum, please exercise care in deciding what information and content you wish to share. Enrollment is voluntary and can be revoked anytime through the FITIV app.

3. How We Use Your Information

FITIV uses information collected to fulfill obligations outlined in the Terms of Service, such as providing heart rate data for detailed workout analysis. We use personal information to:

1. Provide, personalize, and improve the Services
2. Sync workouts, activity, and health data across devices
3. Generate insights, trends, and performance summaries
4. Offer AI-powered features, summaries, and suggestions
5. Communicate updates, support responses, and policy notices
6. Enable participation in the FITIV Community
7. Comply with legal obligations and enforce our Terms of Service

FITIV does not sell or rent your personal information to third parties.

4. AI Features and Data Processing

FITIV uses artificial intelligence to deliver enhanced analysis, summaries, and insights. We employ two distinct types of AI models, each with specific data-handling methods and privacy protections.

4.1 Apple Foundational Models (On-Device AI)

When you use AI features powered by Apple Intelligence or other Apple foundational models, all processing occurs entirely on your device.

• No personal data is transmitted to FITIV servers
• No information is stored, analyzed, or shared by FITIV
• Your AI interactions remain private within your Apple ecosystem

4.2 Cloud-Based AI Processing

Certain FITIV features use cloud-based large-language models to generate advanced insights, summaries, and recommendations. These features are optional and require explicit consent before activation.

When you enable a cloud-based AI feature:

• Only the minimum necessary data (for example, anonymized workout metrics or aggregated trends) is transmitted to secure servers or trusted subprocessors
• Cloud providers are bound by strict confidentiality and data-processing agreements prohibiting reuse, training, or disclosure for unrelated purposes
• FITIV and its subprocessors may temporarily retain this data for debugging or performance verification for no more than 30 days, after which it will be deleted or irreversibly anonymized

AI-generated insights are provided for informational and educational purposes only and may not always be accurate, complete, or contextually appropriate. Do not rely solely on AI outputs for fitness, health, or wellness decisions.

By enabling AI features, you consent to data processing in accordance with this Privacy Policy.

5. Data Sharing and Disclosure

FITIV may share limited data only in these cases:

• With Service Providers: trusted partners who assist with hosting, analytics, customer support, or technical services, bound by confidentiality and data-protection agreements
• With Your Consent: when you connect FITIV to Apple Health, Strava, or other third-party fitness platforms
• For Legal Reasons: if required by law, subpoena, or to protect FITIV’s rights, property, users, or public safety

FITIV does not sell, trade, or otherwise transfer your personally identifiable information to outside parties unless advance notice and consent are provided.

FITIV may share non-personally identifiable information, such as aggregated analytics, app usage trends, or anonymized metrics with partners for legitimate business, research, or marketing purposes.

Google Analytics

We use Google Analytics on our website. Google, as a third-party vendor, uses cookies to analyze site usage. Users may opt out by visiting Google’s Advertising & Privacy policy. FITIV does not use advertising identifiers to serve personalized ads within the FITIV mobile app.

6. Data Retention

FITIV retains your information only as long as necessary to provide the Services and fulfill purposes described in this Privacy Policy.

If you delete your account, all associated personal and health data will be permanently deleted or anonymized within 30 days, except where retention is required by law.

7. Data Security

FITIV uses administrative, technical, and physical safeguards to protect your data against unauthorized access, loss, or misuse. All communications between your device and our servers are encrypted using industry-standard TLS (Transport Layer Security).

Despite our efforts, no method of electronic transmission or storage is completely secure. You use the Services at your own risk.

8. Your Rights and Choices

Depending on your jurisdiction, you may have the right to:

• Access, correct, or delete your personal data
• Withdraw consent for processing at any time
• Request data portability
• File a complaint with your local data-protection authority

9. Children’s Privacy

FITIV does not knowingly collect or solicit personal data from individuals under the age of 16. If we learn that a child’s data has been collected without verified parental consent, we will delete it promptly.

10. International Data Transfers

If you are located outside Canada, your information may be processed in Canada or other jurisdictions with different data protection laws. FITIV ensures transfers comply with legal requirements.

In compliance with CalOPPA, users can visit our site anonymously. A link to this Privacy Policy appears on our homepage. FITIV honors Do Not Track signals and does not allow third-party behavioral tracking.

13. Updates to This Policy

We may update this Privacy Policy periodically. Updates are posted on this page. Continued use of the Services after an update constitutes acceptance.
